Welcome to Ask Bailey! These Terms of Service ("Terms") govern your use of the Ask Bailey mobile application (the "App") and related services (collectively, the "Service"). By downloading, installing, or using the App, you agree to be bound by these Terms.

PLEASE READ THESE TERMS CAREFULLY. If you do not agree with these Terms, you may not use the Service.

1. Acceptance of Terms

By accessing or using Ask Bailey, you confirm that:

• You are at least 18 years old (or 16 with parental consent)
• You have the legal capacity to enter into a binding contract
• You will comply with these Terms and all applicable laws
• All information you provide is accurate and truthful

If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Ask Bailey is an AI-powered dog training coach that provides:

• Personalized Training Plans: Custom training programs based on your dog's profile, breed, age, and behavioral needs
• AI Chat Support: Interactive coaching powered by advanced AI models (OpenAI and Anthropic) to answer your training questions
• Progress Tracking: Tools to log training sessions, walks, and monitor your dog's development
• Training Resources: Step-by-step guides, tips, and educational content

2.1 AI-Powered Features

Our Service uses artificial intelligence to provide training recommendations. While we strive for accuracy, AI-generated content:

• May not be perfect or suitable for every dog
• Should be adapted to your specific situation
• Is educational in nature and not professional advice
• Should be supplemented with your own judgment and research

3. User Accounts and Registration

3.1 Account Creation

To use Ask Bailey, you must create an account by providing:

• A valid email address
• Information about your dog (name, breed, age, behavioral traits)
• Acceptance of our Privacy Policy

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information is accurate and up-to-date

3.3 Account Restrictions

You may not:

• Share your account with others
• Create multiple accounts to abuse free trial features
• Use another person's account without permission
• Impersonate any person or entity

4. Subscriptions and Payments

4.1 Subscription Tiers

Ask Bailey offers the following subscription options:

• Free Tier: Limited access to basic features and AI chat (limited messages per day)
• Premium Subscription: Unlimited AI coaching, advanced training plans, progress analytics, and priority support

4.2 Billing

By purchasing a subscription, you agree that:

• Subscriptions are billed on a recurring basis (monthly or annually)
• Payment will be charged to your Apple App Store or Google Play Store account
• Your subscription will automatically renew unless you cancel before the renewal date
• Prices are subject to change with 30 days' notice

4.3 Free Trials

If you start a free trial:

• You will be charged when the trial period ends unless you cancel
• You can cancel anytime during the trial without charge
• Free trials are limited to one per user

4.4 Cancellation and Refunds

Cancellation: You can cancel your subscription at any time through the App Store or Google Play Store settings. Cancellation takes effect at the end of your current billing period.

Refunds: All payments are processed through Apple or Google's payment systems. Refund requests are subject to their respective refund policies. We do not have access to process refunds directly.

5. Acceptable Use Policy

5.1 Permitted Use

You may use Ask Bailey solely for personal, non-commercial purposes to train your dog(s).

5.2 Prohibited Activities

You agree NOT to:

• Use the Service for any illegal or harmful purposes
• Abuse, harm, or exploit animals based on advice from the App
• Share, sell, or redistribute AI-generated content commercially
• Attempt to reverse engineer, decompile, or hack the App
• Use automated systems (bots, scrapers) to access the Service
• Upload harmful content, viruses, or malicious code
• Harass, threaten, or abuse other users or our support team
• Violate any applicable laws or regulations
• Circumvent usage limits or subscription requirements
• Use the Service to train dogs for illegal activities (fighting, aggression, etc.)

5.3 Content Guidelines

When interacting with our AI or providing information:

• Do not input offensive, abusive, or inappropriate content
• Provide accurate information about your dog
• Respect intellectual property rights

6. Disclaimers and Limitations of Liability

6.1 No Professional Advice

The information provided through Ask Bailey:

• Is for educational and informational purposes only
• Should not be considered professional veterinary or behavioral advice
• Is not a substitute for in-person consultation with experts
• May not be suitable for all dogs, situations, or environments

6.2 "As Is" Service

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, including but not limited to:

• Accuracy, reliability, or completeness of AI-generated content
• Uninterrupted or error-free operation
• Results or outcomes from using the Service
• Fitness for a particular purpose

6.3 Assumption of Risk

You acknowledge and agree that:

• Dog training carries inherent risks
• You use the Service at your own risk
• You are solely responsible for your dog's welfare and behavior
• You will exercise sound judgment and prioritize safety

6.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASK BAILEY AND ITS TEAM SHALL NOT BE LIABLE FOR:

• Any injuries to you, your dog, or third parties
• Property damage resulting from use of the Service
• Loss of data or training progress
• Any indirect, incidental, special, or consequential damages
• Loss of profits, revenue, or business opportunities

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS LESS.

7. Intellectual Property Rights

7.1 Our Rights

Ask Bailey and all related content, including but not limited to:

• App design, logos, and branding
• Training plans and methodologies
• AI models and algorithms
• Software code and architecture

Are owned by Ask Bailey or our licensors and are protected by copyright, trademark, and other intellectual property laws.

7.2 Your Rights

You retain ownership of:

• Your dog's profile information
• Training notes and logs you create
• Photos or content you upload

7.3 License to Use Service

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal purposes only. You may not:

• Copy, modify, or create derivative works
• Sell, rent, lease, or sublicense the Service
• Remove copyright or proprietary notices

7.4 User Content License

By submitting content to Ask Bailey (chat messages, dog profiles, notes), you grant us a worldwide, non-exclusive, royalty-free license to:

• Process your content to provide the Service
• Use anonymized data to improve AI models
• Create aggregated statistics (never personally identifiable)

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key Privacy Points:

• We process your data to provide AI-powered training guidance
• Your chat conversations are shared with OpenAI and Anthropic for AI processing
• We do NOT sell your personal data
• You can request data deletion at any time

9. Third-Party Services

Ask Bailey integrates with third-party services, including:

• AI Providers: OpenAI and Anthropic for chat functionality
• Payment Processors: Apple App Store and Google Play Store for subscriptions
• Cloud Services: Supabase for data storage
• Analytics: Google Analytics for usage insights

These services have their own terms and privacy policies. We are not responsible for their practices or content.

10. Account Termination

10.1 Termination by You

You may terminate your account at any time by:

• Using the account deletion feature in the App
• Contacting us at support@askbailey.app

Upon deletion, your data will be permanently removed according to our Privacy Policy.

10.2 Termination by Us

We reserve the right to suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your account shows signs of abuse or misuse
• Required by law or legal process

10.3 Effect of Termination

Upon termination:

• Your access to the Service will be revoked
• Active subscriptions will be cancelled (no refunds for partial periods)
• Your data will be deleted unless legally required to retain
• These Terms will survive termination where applicable

11. Changes to Terms

We may update these Terms from time to time to reflect:

• Changes in our Service or features
• Legal or regulatory requirements
• Security or technical improvements

When we make changes:

• We will update the "Last Updated" date
• Material changes will be announced via email or in-app notification
• Your continued use after changes constitutes acceptance
• If you disagree with changes, you may terminate your account

12. Governing Law and Disputes

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.

12.2 Dispute Resolution

If a dispute arises:

• Arbitration: If we cannot resolve the dispute, it will be settled through binding arbitration
• Class Action Waiver: You agree to resolve disputes individually, not as part of a class action

Either party may seek injunctive relief in court for intellectual property violations or to enforce these Terms.

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ask Bailey.

13.2 Severability

If any provision of these Terms is found invalid, the remaining provisions will remain in full effect.

13.3 Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.

13.4 Assignment

You may not assign these Terms without our consent. We may assign these Terms to any successor or affiliate.

13.5 No Agency

Nothing in these Terms creates a partnership, employment, or agency relationship between you and Ask Bailey.

13.6 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, internet outages, etc.).
